{"id":24306,"date":"2021-10-27T14:29:37","date_gmt":"2021-10-27T12:29:37","guid":{"rendered":"https:\/\/www.schneider-immobilienbewertung.de\/?p=24306"},"modified":"2021-11-20T11:37:25","modified_gmt":"2021-11-20T10:37:25","slug":"gutachter-zugewinn","status":"publish","type":"post","link":"https:\/\/www.schneider-immobilienbewertung.de\/?p=24306","title":{"rendered":"Gutachter Zugewinn \u2013 BGH entscheidet Grundsatzfrage bei Zugewinnausgleich"},"content":{"rendered":"<p><strong><span style=\"font-size: 18px;\">Gutachter Zugewinn &#8211; BGH entscheidet Grundsatzfrage zum Zugewinnausgleich &#8211; BGH Urteil vom 21.10.2014 &#8211; XI ZR 210\/13<\/span><\/strong><b><\/b><\/p>\n<p align=\"left\"><span style=\"font-size: 16px;\">Um welche Anspr\u00fcche beim Zugewinnausgleich geht es?\u00a0<\/span><span style=\"font-size: 16px;\"><strong>Karlsruhe<\/strong> &#8211; Nach einem Urteil des <strong>BGH<\/strong> <strong>vom 21.10.2014 &#8211; XI ZR 210\/13<\/strong> &#8211; ist die Zahlung eines Zugewinnausgleichs kein unentgeltlicher Verm\u00f6genserwerb. <strong>Der Zugewinnausgleich dient der Teilhabe an dem w\u00e4hrend der Ehe gemeinsam erwirtschafteten Verm\u00f6gen.<\/strong><\/span><\/p>\n<h2>Zugewinnausgleich: BGH entscheidet Grundsatzfrage<\/h2>\n<p><span style=\"font-size: 16px;\">Der Fall ist zwar au\u00dfergew\u00f6hnlich \u2013 und doch hat der BGH mit seiner neuen Entscheidung zum Zugewinnausgleich eine grunds\u00e4tzliche Frage gekl\u00e4rt. Es geht darum, wann der <strong>Zugewinnausgleich<\/strong> eine entgeltliche und wann eine unentgeltliche Zuwendung ist.<\/span><\/p>\n<h2>Zugewinnausgleich: Entgeltliche oder unentgeltliche Zuwendung?<\/h2>\n<p><span style=\"font-size: 16px;\">Der Fall: Die Kl\u00e4gerin, ein Kreditinstitut, nimmt den Beklagten aus einer R\u00fcckzahlungsvereinbarung in Anspruch.<\/span><span style=\"font-size: 16px;\">Darin verpflichtete sich der Beklagte, einen bestimmten Betrag an die Kl\u00e4gerin zu zahlen \u2013 zuz\u00fcglich eines Anteils an einer eventuellen Einkommenserh\u00f6hung, aber auch zuz\u00fcglich der H\u00e4lfte ihm <strong>unentgeltlich zuflie\u00dfender Verm\u00f6genswerte.<\/strong> Beispielhaft genannt sind Lottogewinn, Schenkung und Erbschaft. \u00a0 Nach der Scheidung seiner Ehe erhielt der Beklagte von seiner Ehefrau insgesamt 140.642 \u20ac als Zugewinnausgleich. Die Parteien streiten dar\u00fcber, ob dieser Verm\u00f6genszufluss unentgeltlich erfolgt ist und eine <strong>Zahlungspflicht gem\u00e4\u00df der Vereinbarung<\/strong> begr\u00fcndet.<\/span><\/p>\n<h2>Zugewinnausgleich als unentgeltlicher Verm\u00f6genserwerb?<\/h2>\n<p><span style=\"font-size: 16px;\">Das vorinstanzliche OLG hat die Entgeltlichkeit eines Zugewinnausgleichsanspruchs damit begr\u00fcndet, dass in der Beendigung des G\u00fcterstands und dem damit verbundenen <strong>Ausschluss von der weiteren Teilhabe an einem Verm\u00f6genszuwachs<\/strong> des Ehegatten die ausgleichende Gegenleistung in Form einer gesetzlich vorgegebenen Bedingung liege.<\/span><span style=\"font-size: 16px;\">Dementsprechend sei nach der Rechtsprechung des BFH die Zahlung eines <strong>vorzeitigen Zugewinns ohne Beendigung des G\u00fcterstands<\/strong> als Schenkung und damit als unentgeltliche Zuwendung zu betrachten.<\/span><\/p>\n<h2>Definition des Begriffs &#8222;unentgeltlicher Verm\u00f6genserwerb&#8220;<\/h2>\n<p><span style=\"font-size: 16px;\">Der BGH in Karlsruhe sieht das anders und stellt folgende Vor\u00fcberlegung an: Eine Leistung ist <strong>unentgeltlich,<\/strong> wenn ihr keine Gegenleistung gegen\u00fcbersteht. Mit anderen Worten: Der Leistende gibt einen Verm\u00f6genswert auf \u2013 ihm flie\u00dft aber keine Gegenleistung zu, die diesem Verm\u00f6genswert entspricht.<\/span><span style=\"font-size: 16px;\">Entgeltlich ist eine Zuwendung aber dann, wenn sie zur <strong>Erf\u00fcllung einer rechtswirksamen Verbindlichkeit<\/strong> erfolgt. Denn die dadurch bewirkte Befreiung von der Verbindlichkeit stellt einen Verm\u00f6gensvorteil f\u00fcr den Leistenden dar. Der durch die Leistung erf\u00fcllte Anspruch des Empf\u00e4ngers erlischt.<\/span><\/p>\n<h2>Zweck und Funktion des Zugewinnausgleichs<\/h2>\n<p><span style=\"font-size: 16px;\">Daran gemessen ist die Zahlung des Zugewinnausgleichs, die der Beklagte von seiner geschiedenen Ehefrau erhalten hat, kein unentgeltlicher Verm\u00f6genserwerb. Denn durch diese Zahlung ist seine Ausgleichsforderung gem. \u00a7 1378 Abs. 1 BGB erf\u00fcllt worden.<\/span><span style=\"font-size: 16px;\">Zudem dient der Zugewinnausgleich nach seinem Grundgedanken der Teilhabe an dem w\u00e4hrend der Ehe gemeinsam erwirtschafteten Verm\u00f6gen. Die jeweiligen Leistungen, die die Ehegatten im Rahmen ihrer innerfamili\u00e4ren Arbeitsteilung erbringen, sind grunds\u00e4tzlich als gleichwertig anzusehen.<\/span><\/p>\n<h2>Steuerrechtliche Konsequenzen f\u00fcr den Zugewinnausgleich<\/h2>\n<p><span style=\"font-size: 16px;\">Entsprechend der zivilrechtlichen Einordnung des Zugewinnausgleichs nach der Scheidung einer Ehe als entgeltliche Zuwendung unterliegt die Ausgleichsforderung gem. \u00a7 1378 Abs. 1 BGB in F\u00e4llen, in denen der G\u00fcterstand der Zugewinngemeinschaft in anderer Weise als durch den Tod eines Ehegatten beendet wird, gem. \u00a7 5 Abs. 2 ErbStG nicht der Erbschafts- oder Schenkungssteuer.<\/span><\/p>\n<h2>Gutachter Zugewinn &#8211; Immobilienbewertung f\u00fcr Zugewinn bzw. 16px;\">Der Fall ist zwar au\u00dfergew\u00f6hnlich \u2013 und doch hat der BGH mit seiner neuen Entscheidung zum Zugewinnausgleich eine grunds\u00e4tzliche Frage gekl\u00e4rt. Die Parteien streiten dar\u00fcber, ob dieser Verm\u00f6genszufluss unentgeltlich erfolgt ist und eine <strong>Zahlungspflicht gem\u00e4\u00df der Vereinbarung<\/strong> begr\u00fcndet.<\/span><span data-css=\"tve-u-17cc1aae67c\" style=\"font-size: 16px;\"><strong><\/strong><\/span><\/p><\/div><div class=\"thrv_wrapper thrv_text_element\"><h2 class=\"\" style=\"\">Zugewinnausgleich als unentgeltlicher Verm\u00f6genserwerb?<\/h2><\/div><div class=\"thrv_wrapper thrv_text_element\"><p><span data-css=\"tve-u-17cc1acdd3c\" style=\"font-size: 16px;\">Das vorinstanzliche OLG hat die Entgeltlichkeit eines Zugewinnausgleichsanspruchs damit begr\u00fcndet, dass in der Beendigung des G\u00fcterstands und dem damit verbundenen <strong>Ausschluss von der weiteren Teilhabe an einem Verm\u00f6genszuwachs<\/strong> des Ehegatten die ausgleichende Gegenleistung in Form einer gesetzlich vorgegebenen Bedingung liege.<\/span><br><span data-css=\"tve-u-17cc1acdd3c\" style=\"font-size: 16px;\"><\/span><br><span data-css=\"tve-u-17cc1acdd3c\" style=\"font-size: 16px;\"><\/span><span data-css=\"tve-u-17cc1acdd46\" style=\"font-size: 16px;\">Dementsprechend sei nach der Rechtsprechung des BFH die Zahlung eines <strong>vorzeitigen Zugewinns ohne Beendigung des G\u00fcterstands<\/strong> als Schenkung und damit als unentgeltliche Zuwendung zu betrachten.<\/span><br><span data-css=\"tve-u-17cc1acdd46\" style=\"font-size: 16px;\"><\/span><\/p><\/div><div class=\"thrv_wrapper thrv_text_element\"><h2 class=\"\" style=\"\">Definition des Begriffs \"unentgeltlicher Verm\u00f6genserwerb\"<\/h2><\/div><div class=\"thrv_wrapper thrv_text_element\"><p><span data-css=\"tve-u-17cc1af7337\" style=\"font-size: 16px;\">Der BGH in Karlsruhe sieht das anders und stellt folgende Vor\u00fcberlegung an: Eine Leistung ist <strong>unentgeltlich,<\/strong> wenn ihr keine Gegenleistung gegen\u00fcbersteht. Mit anderen Worten: Der Leistende gibt einen Verm\u00f6genswert auf \u2013 ihm flie\u00dft aber keine Gegenleistung zu, die diesem Verm\u00f6genswert entspricht.<\/span><br><br><span data-css=\"tve-u-17cc1af733c\" style=\"font-size: 16px;\">Entgeltlich ist eine Zuwendung aber dann, wenn sie zur <strong>Erf\u00fcllung einer rechtswirksamen Verbindlichkeit<\/strong> erfolgt. Denn die dadurch bewirkte Befreiung von der Verbindlichkeit stellt einen Verm\u00f6gensvorteil f\u00fcr den Leistenden dar. Der durch die Leistung erf\u00fcllte Anspruch des Empf\u00e4ngers erlischt.<\/span><span data-css=\"tve-u-17cc1af7343\" style=\"font-size: 16px;\"><\/span><br><\/p><\/div><div class=\"thrv_wrapper thrv_text_element tve-froala\"><h2 class=\"\" style=\"\">Zweck und Funktion des Zugewinnausgleichs<\/h2><\/div><div class=\"thrv_wrapper thrv_text_element\"><p><span data-css=\"tve-u-17cc1b21598\" style=\"font-size: 16px;\">Daran gemessen ist die Zahlung des Zugewinnausgleichs, die der Beklagte von seiner geschiedenen Ehefrau erhalten hat, kein unentgeltlicher Verm\u00f6genserwerb. Denn durch diese Zahlung ist seine Ausgleichsforderung gem. \u00a7 1378 Abs. 1 BGB erf\u00fcllt worden.<\/span><br><span data-css=\"tve-u-17cc1b21598\" style=\"font-size: 16px;\"><\/span><br><span data-css=\"tve-u-17cc1b21598\" style=\"font-size: 16px;\"><\/span><span data-css=\"tve-u-17cc1b215a3\" style=\"font-size: 16px;\">Zudem dient der Zugewinnausgleich nach seinem Grundgedanken der Teilhabe an dem w\u00e4hrend der Ehe gemeinsam erwirtschafteten Verm\u00f6gen.
